Uninsured hit insured company truck that ran red light in Houston. Insurance appraised & deducted 30%.How?
My bf driving through intersection breaked but still hit a company owned pickup truck that ran red light in Houston, Texas. My bf is uninsured and police gave other driver citation for running red light. The insurance company appraised my bf’s vehicle and offered 30% less because they said the damage on my bf’s vehicle sustained (totaled) was a lot due to him speeding. The insurance company is not willing to pay for 1 doctor visit or rental car either. What is the insurance company trying to do and what are they trying to get away with?
BF is certain he was not speeding. There were no citations issued to BF (that I know of but even then, no license was revoked or anything like that.) It’s between the insurance company and BF now so how could the insurance company win a battle over the alleged speeding when thus far, there is no proof?
I appreciate your answers with opinions regarding my BF being uninsured but as the answers continue they’re losing focus on my question. "Littlebi.." your answer was unacceptable on Yahoo! Answers in my opinion.
My BF used to have insurance and doesn’t anymore but other than that he’s a complete, law abiding citizen and he’ll most likely get insurance again in the future. I was hit by a drunk, underaged, illegal alien with no insurance on 1-24-09 so there is definite proof that many uninsured motorists are on the road. 1 in 5 Texans doesn’t have auto insurance.
I want to tell you that I love the answers so far, they’re helpful in my research so for that I am very thankful.
My question is extended, what is the insurance company trying to do and how can they prove he was speeding?

They are doing what many insurance companies do. Trying to weasel out of paying a claim in part because they know he has no insurance to go to bat for him and they also know that he will have to hire a lawyer to get for him what he deserves.

They’re trying to cut their losses by partially blaming your BF for the accident since he was supposedly speeding. Some companies almost automatically try to shift some of the blame onto the other driver for this reason; sometimes it’s correct, sometimes not. If he’s sure he wasn’t speeding, tell the company that it’s not acceptable and you want full payment. Then go get some insurance for him, if he gets to keep his license–it should be suspended until he does.

They have assigned him 30% of the blame for speeding and perhaps for being uninsured. Under TX law, established in 2005, he would have been required to show his insurance card at the time of the accident. If he couldn’t, he would have been ticketed. Be happy the other insurance is only dropping it by 30%.

It’s called "contributory negligence", meaning that the insurance company has decided both drivers are partially responsible for the collision.
Why doesn’t your boyfriend have insurance? He shouldn’t have even been on the road, and that may be the issue here.

I’d say he deserves no money at all. Uninsured motorists are no better than litter on the road! What if he had hit that truck? How much would he be willing to pay them?
